This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the Website.

The domain name www.bookmyforex.com (hereinafter referred to as "Website") is owned by BookMyForex Private Limited, a company incorporated under the Companies Act, 1956 with its registered office at Unit 657-658 Tower C, JMD Megapolis, Sector 48, Sohna Road, Gurgaon 122018, Haryana India (hereinafter referred to as BookMyForex or BMF). Both terms,BookMyForex and BMF, are an integral part of BookMyForex Pvt. Ltd business and are protected under the intellectual property rights law of India. BMF and BookMyForex form part of the logo of the Website and business operated by BookMyForex Pvt. Ltd. Infringement of any right, accrued to BookMyForex qua our intellectual property, shall be subject of prosecution, for which you are hereby deemed to be notified.

The use of the Website i.e. www.bookmyforex.com, services and tools are governed by the following terms and conditions (these terms and conditions shall be referred to as "Terms of Use" hereinafter) as applicable to the Website including the applicable policies which are incorporated herein by way of reference. If You transact on the Website, You shall be subject to the policies that are applicable to the Website for such transaction. By mere use of the Website, You shall be contracting with BookMyForex Private Limited and these terms and conditions including the policies constitute Your binding obligations, with BookMyForex. For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a purchaser, seller or remitter on the Website by providing information and Data on the Website as required for using the computer systems. BookMyForex allows the User to browse the Website but does not allow the user to make purchases, sale and remittance without providing the information as required from a natural or legal person for transactions qua 'Foreign Exchange products' on the Website or otherwise. The term "We", "Us", "Our" shall mean BookMyForex Private Limited for all intents and purposes, unless repugnant to the context.

When You use any of the services provided by us through the Website, You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into these Terms of Use and shall be considered as part and parcel of these Terms of Use. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to You. It is Your responsibility to review these Terms of Use periodically for updates / changes. Your continued use of the Website following the posting of changes will mean that You accept and agree to the revisions or updates as the case may be. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website.

ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by the policies of BookMyForex, as available as public notice on the Website or otherwise, as amended from time to time.

Use of the Website is available only to persons who can form legally binding contracts under The Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including but not limited to minors, un-discharged insolvents etc. are not eligible to use the Website. If You are a minor i.e. under the age of 18 years, You shall not be eligible to be a User of the Website and shall not transact on or use the Website. As a minor if You wish to use or transact on the Website, such use or transaction may be made by Your legal guardian or parents on the Website. BookMyForex reserves the right to refuse to provide You with access to the Website if it is brought to our notice or if it is discovered that You are under the age of 18 years.

You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the present Terms of Use, We shall have the right to refuse to provide You with access to the Website.

When You use the Website or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with You by email or by such other mode of communication, electronic or otherwise.

The Website is a Foreign Exchange market place, this market place is facilitated by the information technology and programming based electronic platform that Users utilize to get competitive rates of foreign exchange products(Foreign Currency notes, travelers cheques, Forex Cards., etc. shall be referred to as 'Foreign Exchange Products' herein for all intents and purposes in these present terms of use, unless repugnant to the context) for their personal transactions in accordance with the applicable laws.

BookMyForex is not and cannot control in any manner the actual transaction (The stage of the final execution of the confirmed transaction, wherein the channel partner physically or digitally hands over the forex/currency as confirmed to the user in the order shall be termed as actual transaction.) between the Website's Users and its channel partners (The Banks and other financial institutions, which are registered with the RBI for the purpose of foreign exchange and are further associated with BookMyForex for facilitation of transactions qua foreign exchange products for the user shall be referred to as channel partners herein, this term shall also include the foreign exchange branch of BookMyForex registered with the RBI.).

BookMyForex is not responsible for any non-performance or breach of any contract entered into between the users and our channel partners. BookMyForex cannot and does not guarantee that the concerned channel partner will perform any transaction concluded on the Website if the transaction is a no-obligation transaction. BookMyForex shall not and is not required to mediate or resolve any dispute or disagreement between the user and the channel partner, if there is any dispute between the channel partner and the user then the user or channel partner must endeavor to communicate directly and resolve such issues with the channel partner or user respectively.

You release and indemnify BookMyForex and/or any of our officers and representatives from any cost, damage, liability or other consequence of any of the actions of the channel partners and other users of the Website and specifically waive any claims that You may have in this behalf under any applicable law. Notwithstanding its reasonable efforts in that behalf, BookMyForex cannot take responsibility or control the actual transaction between the user and the channel partner.

The completion of all booked and confirmed orders placed by the user are subject to availability of the specifically ordered Foreign Exchange products. In case of No-obligation orders we reserve the right to change the transacting rates of the Foreign Exchange Products on the basis of the availability of the specifically ordered Products at the time of actual transaction.

UNDERTAKINGS OF A USER

You agree, undertake and confirm that Your use of the Website shall be strictly governed by the following binding principles:

1. 1. You shall not host, display, upload, modify, publish, transmit, update or share any information which:
   2. belongs to another person and to which You, the user, does not have any right to host, display, upload, modify, publish, transmit, update or share;
   3. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
   4. is misleading in any way;
   5. is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
   6. Harasses or advocates harassment of another person;
   7. Involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";
   8. promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
   9. infringes upon or violates any third party's rights including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity];
   10. promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
   11. Contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
   12. Provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
   13. Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
   14. Contains video, photographs, or images of another person (with a minor or an adult).
   15. Tries to gain unauthorized access or exceeds the scope of authorized access to the Website or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Website or solicits passwords or personal identifying information for commercial or unlawful purposes from other users.
   16. Engages in commercial activities and/or sales without Our prior written consent such as contests, sweepstakes, barter, advertising and pyramid schemes, or the buying or selling of "virtual" products related to the Website. Throughout this Terms of Use, BookMyForex's prior written consent means a communication coming from BookMyForex's Legal Department, specifically in response to Your request, and specifically addressing the activity or conduct for which You seek authorization;
   17. Solicits gambling or engages in any gambling activity which We, in Our sole discretion, believe is or could be construed as being illegal;
   18. Interferes with another user's use and enjoyment of the Website or any other individual's User and enjoyment of similar services;
   19. Refers to any website or URL that, in Our sole discretion, contains material that is inappropriate for the Website or any other website, contains content that would be prohibited or violates the letter or spirit of these Terms of Use.
   20. Harm minors in any way;
   21. infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen products;
   22. violates any law for the time being in force;
   23. Deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
   24. Impersonate another person;
   25. contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancel bots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;
   26. Threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
   27. is false, inaccurate or misleading;
   28. directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force.
   29. shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or other suppliers;

You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm, code or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. We reserve our right to bar any such activity and refuse access for the safety of other users and their privacy.
3. You shall not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website or to any server, computer, network, devices or to any of the services offered on or through the Website, by hacking, password "mining" or any other illegitimate and/or illegal means.
4. You shall not probe, scan or test the vulnerability of the Website or any network connected to the Website nor breach the security or authentication measures on the Website or any network connected to the Website. You may not use reverse look-up, trace or seek to trace any information on any other User or visitor of the Website, to its source, or exploit the Website or any service or information made available or offered by or through the Website, in any way for any purpose including the purpose to reveal any information, including but not limited to personal identification or information, other than Your own information, as provided for by the Website.
5. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Website or any transaction being conducted on the Website, or with any other person's use of the Website.
6. You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal You sent to Us on or through the Website or any service offered on or through the Website. You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity.
7. You may not use the Website or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of BookMyForex and / or others.
8. You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Anti Money Laundering guidelines, Prevention of Money Laundering Act, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Octroi, GST / SGST, Central Excise, Custom Duty, Local Levies) regarding Your use of Our service and our channel partner's listing, purchase, solicitation of offers to purchase, and sale. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force and along with their amendments.
9. Solely to enable Us to use the information You supply us with, so that we are not violating any rights You might have in Your Information, You agree to grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise the database rights or any other rights You have in Your Information, in any media now known or not currently known, with respect to Your Information. We will only use Your information in accordance with the Terms of Use applicable to use of the Website and/or laws applicable to the present Agreement.
10. BookMyForex shall have all the rights to take necessary action and claim damages that may occur due to Your involvement/participation in any way on Your own or through group(s) of people, intentionally or unintentionally in any act in contravention of any law or causing any harm to BookMyForex or our channel partners or our users.

USE OF THE WEBSITE AND SERVICES

1. By using or visiting our website/ mobile apps, you acknowledge that by creating any kind of order or request on our website/ mobile apps, you are explicitly giving us and any of our channel partners the permission to send out communications to you via call, email, Whatsapp messages or SMS regarding your order or regarding marketing promotions that are being carried out by us.
2. You are hereby notified that You must be well aware of the rules & regulations and the risks involved in booking foreign exchange products. We will not be held responsible for any data accessed, stolen, misused or misappropriated in any way by any third party due to unauthorized use of the Website by any third party intentionally or unintentionally.
3. You are believed to have read and to have understood these Terms as well as all eligibility criteria and other formalities applicable to the Services being offered and undertake to abide by the same and do not dispute them.
4. We shall endeavor to make all reasonable efforts to give You a hassle-free transaction of foreign exchange products for your personal use, however, we are not agents of any Bank, any currency exchange company, any mobile phone operator, any sim card vendor or any insurance company and will not be responsible for the actual transaction between  users and channel partners including but not limited to losses incurred by users on account of delay in service, soiled Bank notes, Old series notes, currency notes with any mark, counterfeit Indian Currency, soiled or/and counterfeit foreign currency notes exchanged between the user and the channel partners, or inactivated sim card, incorrect/unauthorized transactions on Forex cards, delay in transactions or Card fundings/unloadings due to third party bank servers, lapse or delay in insurance or any other discrepancy or dispute that may arise between the channel partner and the user on account of channel partner's standards and flaws in order of processing by a the channel partner associated with us. The user is responsible for checking the condition of the Indian or foreign currency notes upon delivery. Post delivery, BookMyForex will not be held responsible for any replacement of currency notes or any losses incurred due to the delivery process, whether caused by the delivery/channel partner or the customer.
5. That if any discrepancy is detected in the documents furnished by You at any time of applying for foreign exchange or the details as furnished by You are found to be incomplete or inaccurate, which inaccuracy, discrepancy or error are detected at any stage of the process, or the channel partner finds that execution of the order made by You is in violation of any applicable laws rules, regulations, notifications, guidelines, ordinances, amended Government Policies, RBI Bank Policies or for reasons beyond the control of BookMyForex or our channel partner leading to cancellation of the transaction our channel partner shall not process the request any further and they would be fully entitled to cancel the transaction at their sole discretion without any further notice to the You. In the said event the amount deposited by You for the transaction would be credited to Your Account within 30 days after deducting the applicable cancellation charges etc. and in the said event, You shall not have any right to raise any claim against us or any of our agents, officials, employees or assigns or our channel partner or any of their agents, officials, employees or assigns, In excess of which the present terms of use contain a cancellation policy qua the products and services available through us, the same shall be binding in all cases of voluntary or involuntary cancelations.
6. We would not, under any circumstance, be liable for any transactions executed by the user on websites hosted by any third party.
7. If you are transacting through us for Foreign Exchange, You have been deemed to represent that the total amount of foreign exchange purchased from or remitted through, all sources including through this service is within the prescribed limits set forth by the Reserve Bank of India (RBI) and is also as per the Exchange Control Regulations of RBI in operation at the time of the transaction and the applicable laws in force from time to time.
8. We will not be held liable for failure of Forex Travel Cards issued by Banks, channel partners directly or by exchange companies associated with us as channel partners including but not limited to reasons such as bank's server downtime, card not working at POS, ATM Authentication failure, PIN not working, delay in card funding for more than predefined turnaround time or any dispute, discrepancy on any transaction made using forex card etc. In all cases of service deficiency, disputes, malpractice, illegal trade practices, You must contact the issuing Bank or Financial institution directly. We may coordinate with Banks or Exchange companies to facilitate better customer service without assuming any responsibility whatsoever on behalf of the channel partners or exchange companies for any deficiency of service or illegal trade practices. Furthermore, in case of any insurance policies purchased by you through us, the said policies would be subject to its own set of regulations and laws. We would not be liable for any change in the same, any dispute regarding the same would be subject matter to resolution between the financial institution issuing the said policy and the user.
9. We shall not be held liable for any act done by our officers, employees, representatives, assigns, agents etc. which is beyond the scope of their employment or regular course of duty. We do not charge any commission or extra fee for the purposes of expediting your transactions. We shall not be liable for any person including our officers, employees, representatives, assigns, agents or the officers, employees, representatives, assigns, agents of our channel partners misrepresenting the same to you by illegally or inappropriately rendering any services not offered on the website, you are advised to report such incidents, with full details, at the earliest to the grievance officer.
10. We shall not be held liable to You for non-availability of the Services for any reason including but not limited to natural calamities, legal restraints, network failure, or any other reason beyond our control.
11. We would, under no circumstance, be liable for any damage/ injury of whatsoever nature sustained by You or by any other person authorized or benefiting on Your behalf. You, by way of the present Terms of use, are put to notice that we may hold and process Your Personal Information provided by You and all other information concerning Your Account(s) on the computer system or otherwise in connection with the Service being facilitated or availed of by You from Us. It is further clarified that no responsibility of any such information being illegally or wrongfully being accessed by any third party or any unauthorized entity shall be fastened on us for any intent or purpose.
12. Offers/Schemes provided by/on the Website are exclusively for users of the Website, and are applicable only under specific circumstances as may be elucidated and elaborated upon during the operation of the relevant and concerned scheme and may or may not be applicable on some commodities or services listed on the Website. All offers are applicable within validity stated under offer details. Coupon code may get invalid with or without prior information about the same and no specific notice may be served upon the user under any circumstance for any such expiry.
13. We shall not be liable in any case of non-applicability of third party offers listed on the Website. The User agrees to read all terms and conditions regarding the specific scheme/offer in operation at the relevant time before applying.
14. Please be aware that we do not accept currency orders containing damaged, counterfeit, or outdated notes in currency sale/ purchase transactions under any circumstances

All Foreign Exchange transactions are subject to Government Taxation, Current Service Tax incorporating all Amendments are as follows:

Applicability of GST/SGST as per order size:

1. As stipulated by the Government of India, any conversion from one currency to another - sale, encashment & remittance will be charged a GST/SGST on the gross amount of currency exchanged as per the following slabs:
2. 0.18% of the gross amount of currency exchanged for an amount upto ₹100,000, subject to the minimum amount of ₹45
3. ₹180 and 0.09% of the gross amount of currency exchanged for an amount of rupees exceeding ₹100,000 and upto ₹10,00,000
4. ₹990 and 0.018 % of the gross amount of currency exchanged for an amount of rupees exceeding ₹10,00,000, Subject to Maximum of ₹10,800/-

GST / SGST rates, rules may change from time to time, our channel partners will charge applicable GST / SGST. While efforts will be made to update amendments in GST / SGST on the Website, we take no responsibility if the latest amendments are not immediately updated on the Website.

FOREIGN EXCHANGE PRODUCTS

1. We provide a platform for transaction of foreign exchange products limited to bank operated Foreign Exchange Cards, vendors for currency notes, remittance of foreign exchange. The transaction is facilitated through third party vendors only, and we are in no way an agent, or in any way responsible for the execution of the transaction, if there is any dispute qua the same, please contact the third party vendor for the resolution of the same. BookMyForex will not be liable for any claim arising out of any such issue, you hereby are notified of the same.
2. The above mentioned products are available on the portal. You may access the portal and select the Foreign exchange as per your needs. You may then select the mode in which you wish to purchase the foreign exchange, in form of a multi currency card, which is prepaid and reloadable, currency notes or travellers cheques.

CANCELLATION & REFUND POLICY(FOREX TRANSACTIONS)

In the event of You confirming eligibility to book any retail forex product including but not limited to Prepaid Forex Card or Traveler's Cheques or Foreign currency notes or Foreign Currency Demand Draft or an outward remittance transaction, You shall be given an option of either a NO-OBLIGATION TRANSACTION or a FIXED RATE TRANSACTION:

1. CANCELLATION OF ORDERS AGAINST NO-OBLIGATION ORDER (ORDERS WHERE THE RATE ISN'T FIXED):

   1. In the eventuality that You select the option of a No-obligation Transaction, You shall be required to confirm eligibility to book a retail forex / outward remittance transaction but are not required to deposit any advance deposit or upfront full payment equivalent to order total to freeze transaction rates and the transaction rates applied are those that appear on the Website at the time of actual transaction.
   2. No-obligation orders can be cancelled by You or us or our channel partners by way of a written request, notifying the other concerned party of the cancellation, which shall be furnished at least 2 hours before the stated time of actual transaction or before making Full payment of the order. There is no charge for cancellation of a no-obligation transaction.
   3. No obligation orders cannot be cancelled once the actual transaction has been executed.
   4. No obligation order cancellation will be levied with cancellation charges if Full payment is already received to the executing channel partner/vendor

2. CANCELLATION OF FIXED RATE ORDERS:

   1. In case of a fixed rate order, we offer the users of the Website the opportunity to freeze the Foreign Exchange product transaction rates, as available live, online. Which means that you will receive the exact same rate that you see on the website, as frozen by you on the website, however, these fixed rates shall only be applicable if the actual transaction is executed within three working days including booking day.
   2. Fixed rate orders can be booked either by paying a fully refundable rate guarantee non-adjustable deposit of 2% of the booked transaction value or by making full payment upfront via BMF website while placing the order or post placing the no-obligation order. The aforementioned advance may be paid by a credit or debit card or through net banking, using our secured payment gateway or by NEFT / RTGS.
   3. Fixed rates transactions require us to solidify your booked order, which means on you confirming a fixed rate order, we place back-to-back orders to freeze rates for you with our trusted channel partners and hence we cannot cancel such an order, However, if such an order is found to be irregular for reasons including but not limited to non-compliance of the applicable laws, rules, regulations, notifications, ordinances or by- laws or for non-availability of supporting documents required as per RBI / FEMA guidelines or the Anti-Money laundering Guidelines of the RBI, the same will automatically be cancelled at our instance or by our channel partner Cancellation of a booked forex order incurs losses to us, including but not limited to the rate fluctuation swap losses and manpower costs. To recover such losses, the non-adjustable deposit payment made by You, not exceeding 2% of the transaction value, shall stand forfeited with or without any further notice. In case of cancellations of orders with only full payment received, 2% of the order total will be deducted and remaining amount will be refunded (Payment Convenience Fee will not be refunded in any case)
   4. You are hereby deemed to have been notified that any Cancellation of fixed rate orders by you, on your booked fixed rate orders or on account of regulatory requirements or under any circumstances will attract cancellation charges of our channel partners apart from currency swaps and will result in the fixed rate deposits, as mentioned hereinabove, being forfeited with or without any further notice to you.
   5. Further, the foreign exchange products would be issued subject to Your eligibility in terms of the applicable laws, rules, regulations, bye laws, ordinances and notifications, as well as verification of the documents submitted by You to our channel partners. Our channel partners may refuse to fulfil orders for reasons of non-compliance, suspicious transactions as required under RBI / FEMA guidelines or Anti-Money laundering Guidelines of the RBI. It is clarified that we shall not be responsible or be held liable for any damage of injury caused to You in such eventuality, and You may approach the channel partner in this regard directly for all and every clarification
   6. 2% of the order total will be deducted or forfeited from the paid amount even in following other cases where BMF is not able to execute the orders within 3 working days including order booking day

   True Zero Markup Forex Card

   1.    TRAVEL INSURANCE

   All insurance related products are regulated as per the IRDAI rules and regulations, all the offers available on our portal are subject to the offer document that is been given by the insurer, we do not have any role to play in the same. The offer document must be properly read before entering into the same. The offer document is presented and prepared by the insurer and BookMyForex/ BookMyForex is not an agent and does not in any way endorse any insurance policy, all and every insurance policy is promoted by the insurer and the user is liable to be aware of the contents of the same before entering into the insurance policy with any insurer. You hereby indemnify us and all our officers from any claim that may arise qua the insurance policy. All and every claim qua insurance may only be resolved by the insurer and not by BookMyForex/ BookMyForex or any of its officers.

3. CANCELLATION & REFUND/CHARGEBACK TERMS AND CONDITIONS (INSURANCE PRODUCTS)

   Cancellation of all insurance policies are subject to the insurance policy and are particular to the same. BookMyForex/ BookMyForex in no way has any responsibility or duty in case of cancellation of any policy the same can only be conducted through the insurer. Any such ancilliary services to be conducted are a personal agreement between the insurer and the insured, thus, you are hereby notified that BookMyForex/ BookMyForex shall not be liable for any refund or cancellation.

   All payments with respect to refunds as stated under this paragraph 1 shall be the sole responsibility of the insurer per the rules and regulations laid down by the IRDAI. You understand that BookMyForex has tied up with RBI authorized payment gateways to allow you to make online payments towards your insurance premium amount and is only acting as a mere facilitator and may, if possible extend its assistance to its customers for speedy refunds.

   CHARGEBACKS

   You may dispute a transaction carried out through our Website and file a Chargeback with your issuing bank for the reversal of that transaction. Chargeback allows transactions to be reversed by you under specified circumstances such as, on account of (i) alleged forgery of the card number / bank account or other details (ii) any charge/debit made on a card that has been listed as a hot listed card or otherwise listed on the card association (Visa, MasterCard, etc.) warning bulletins (iii) duplicate processing of the transaction; or (iv) for other reasons as per applicable rules and guidelines issued by RBI, card Associations, your card/payment instrument issuing bank etc. However, we reserve the right to reject a Chargeback, including but not limited to, under the following circumstances:

   1. In the event your medical tests or underwriting is in process with your chosen insurer, not exceeding a period of 3 months from the date of your insurance policy application
   2. In the event there is any delay caused on the part of the insurer in conducting medical tests or during the process of medical underwriting or issuance of insurance policy or any service provided by the insurer in connection with the insurance policy issuance, not exceeding a period of 3 months from the date of your insurance policy application
   3. In case your insurance policy application is rejected by the insurer, post your medical test BookMyForex shall not be liable to you, in any form or manner whatsoever, for any claims, disputes, proceedings which may arise in connection with Chargebacks initiated by you in the circumstances as specified under (1), (2) and (3) herein above.

   TOUR BOOKINGS AND TRAVEL RELATED PRODUCTS

   All bookings for travel as may be listed on the portal are a listing of third party vendors and are not the private bookings by BookMyForex, any alterations, modifications and cancellations are specific to the particular booking and its conditions, please go through the conditions before choosing your booking. Once a tour booking has been executed at the end of BMF, the said booking can only be altered by the third party vendor at its discretion subject to the conditions it has levied on such bookings. After booking the tour or travel arrangement, the said booking would be a personal contract between the tour or travel operator or third party vendor and the user and you are hereby notified that the same shall not in any way be the responsibility or duty of BookMyForex.

   Any cancellation qua any travel or tour booking made on the portal qua tours and travels shall be conducted by the Third party vendor making the listing.

   INTERNATIONAL SIM CARDS

   We list international Sim cards on the portal for your convenient search and purchase, the said Sim cards are listed by third party vendors, BookMyForex is not an agent or a representative of any sim card operator and thus, not liable qua the service of the same, any disputes qua the sim card may be taken up with the sim card operator by the user.

   Once you have confirmed the purchase of the sim card, it shall be shipped to you, and shall be activated as per your requirement or pre approved conditions.

   CANCELATION OF SIM CARDS

   The cancellation of sim cards may be done by calling the sim card operator or through the BookMyForex support, in case you have purchased a sim card and the same has not been delivered to you, then the said SIM card may be cancelled and a full refund shall be furnished to you within 21 working days.

   In case you have purchased a SIM card, and the same has been delivered to you, however, not activated yet, the same may be cancelled however, only 50% of the amount shall be refunded to you.

   No cancellation is possible if and once the SIM card has been activated.

   Any issues faced by the user qua the SIM card may be taken up with the Sim card operator and BookMyForex shall have no liability or duty qua the same, BookMyForex is only a facilitator of the service and does not endorse or warrant the sale of any specific product.

   COMPLIANCE WITH LAWS

   The users and channel partners shall comply with all the applicable laws (including without limitation Foreign Exchange Management Act, 1999 or Anti-Money laundering Guidelines of the RBI) and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by Reserve Bank of India from time to time, Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the rules made there under, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under, applicable to them respectively for using Payment Facility and BookMyForex.

   • I authorize BookMyForex and / or its associates to verify any information or otherwise at my office / residence or to contact me, my employer / banker / credit bureau / RBI or any other source to obtain or provide any information that may be required for maintaining any account in good standing.

I also accept that BookMyForex or YES BANK reserves the right to regularize negative Card balance by debiting my accounts or any other Prepaid Card held with any bank without giving any prior notice.
   • I acknowledge that I carry the risks of reloading a wrong Card number by communicating a wrong Card number to BookMyForex. understand that BookMyForex cannot be held responsible for the same.
   • I agree and acknowledge that the fees are nonrefundable.
   • I understand that ATMs / EDC terminals are machines and errors could occur while in operation. I agree to indemnify BookMyForex and YES BANK for any such machine / mechanical errors / failures.
   • I understand that the Alert facility offered by Book My Forex Pvt Ltd will enable me to receive customized Alert messages through the Short Messaging Service (""SMS"") over my mobile phone, as chosen by me, with respect to events and transactions on my Card.
   • I have read and understood the Terms and Conditions relating to the Alerts service being offered by BookMyForex. If this Application Form is accepted I shall be bound by the said Terms and Conditions as in force, and as may be amended by BookMyForex and use of Alert facility will be deemed to be acceptance of those Terms and Conditions.
   • I certify that the details furnished in this Application Form are correct and I give my consent to receive such information under this Alert Facility.    • The Cardholder hereby unconditionally and irrevocably authorizes the Bank to block/ cancel or terminate the Card, in the event, details of the Cardholder or any of the transaction on the Card comes under the category of any of the prudent list of the Bank/RBI or any other statutory authority or the Cardholder's validation fails against NSDL. Further, the Cardholder hereby agrees and confirm that upon cancellation/ termination of the Card, the Cardholder shall approach the Bank for refund of the balance, if any, on the Card as per the refund process of the Bank applicable on the Card.

   Declaration which must be accepted by customers funding / reloading their BookMyForex-YBL cards

   • I hereby apply for the issue of a BookMyForex Multi Currency Forex Card to me and declare that the information included in the application is true and correct and that I am eligible to apply for an internationally valid Card.    • I agree that I will be solely liable for any penalties and / or action under the local laws and/or regulations as may be in force, governing the purchase, refund and use of Forex Card issued by BookMyForex Terms & Conditions I/We, the undersigned being a customer of Book My Forex Pvt Ltd. I/ We understand that BookMyForex may at its sole discretion. at any time and from time to time, without prior or post intimation to me/us, add, alter or modify any of the said terms and conditions and that I/ We hereby agree to abide and be bound by all such changes as if they form part of the terms and conditions and that any transaction with BookMyForex and/or usage of any services by me/us subsequent to such change shall be deemed and tantamount to my/our acceptance of all such changes.

If, despite the limitation above, BookMyForex or its Affiliates are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then the liability of BookMyForex and/or Its Affiliates will in no event exceed, in the aggregate, the greater of (a) the service fees you paid to BookMyForex in connection with such transaction(s) on this Site, or (b) Rupees One Hundred only (INR 100) The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of BookMyForex, Its affiliates, and/or their respective service providers.

   JURISDICTION

   Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction for all disputes or any issues shall be exclusively in Gurgaon, Haryana.

   LIMITATION OF LIABILITY

   IN NO EVENT SHALL BookMyForex BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THESE TERMS OF USE, EVEN IF THE USER HAS BEEN INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.

   If any complaint is received by the above mentioned officer, on their official address, addressed to them in their official capacity as a grievance officer with proper and accurate responding contact details, then an appropriate response shall be given to the complaining legal or natural person after a due inquiry in the matter of their complaint, within one month of the receipt of such a complaint.
